1. ACCESS: First Class Fitness Staffed hours are located on our door and website. All members and visitors must scan their access pass at the front door to gain access to the gym. Do not allow anyone to enter with you without scanning. Members are to advise of any changes of name or contact details. Members understand that the facilities are available to the general public and not exclusively for members. If you are under the age of 16 it is recommended not to enter the gym outside of staffed hours. If you do then you do at your own risk. Your parent or guardian must give consent for you to participate in programs prescribed at the gym and are responsible for any outstanding debt owed to Frances Health & Fitness PTY LTD
2. CONDUCT/BEHAVIOUR: Management reserves the right to refuse entry, suspend or cancel a membership without refund. Management can request any person to leave the premises if that person does not behave in a responsible manner, uses abusive or unacceptable language, is disrespectful to staff, is under the influence of drugs and/or alcohol or does not adhere to the general conditions of entry. CCTV will be constantly monitoring the gym.
3. FITNESS AREAS: Towels must be used at all times. Disinfectant wipes are provided within the gym. All Covid 19 safety policies must be followed at all times in accordance with First class fitness Covid safety plan. Correct training attire and runners to be worn in gym. Shirts or singlets must be worn at all times.
4. VIDEO SURVEILLANCE, MOTION DETECTORS, EMERGENCY DURESS: Our facility is constantly monitored by CCTV cameras along with motion detectors. We have duress buttons throughout the centre. It is your responsibility to make sure you know where the duress buttons are at all times. Evacuation procedures are also wall mounted around the gym.
5. MEMBERSHIP PAYMENT TERMS: Please see Debit Success terms and conditions.
6. SWIPE ACCESS: All members must swipe in at front door any time they enter the centre. If you let other members tailgate on entry or give your swipe access to any other member your membership will be cancelled and a $250 fee will be charged.
7. MEMBERS IMAGES: It is a condition of entry that members images can be used for promotional purposes.
8. TRANSFER OF MEMBERSHIP TERMS: All transfers must be approved by First Class Fitness management and applicable forms to be signed.
9. LIABILITY TERMS: First Class Fitness is not responsible for any lost or stolen items or damage to property or vehicles. Lockers & pigeonholes are available but are not monitored by staff. Any member who wilfully or neglectfully causes such damage shall pay damages to the gym. Members and visitors waive and release First Class Fitness of any liability, without limitation. All injuries which may occur, regardless of negligence, as a result of:
(a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction.
(b) The sudden and unforeseen malfunctioning of any equipment.
(c) Any dietary recommendations.
(d) Slipping and/or falling while on the premises, including adjacent footpaths and parking areas.
We strongly advise if you suffer from a heart condition that you do not use our facility during non-staffed hours and obtain a medical certificate from your doctor, if you do so, you do at your own risk.
10. MANAGEMENT RESERVES THE RIGHT: To Suspend or cancel without refund to any person whose conduct is deemed improper or in any way detrimental to the business. To close off any part of the premises or any piece of equipment for maintenance (or for any reason) at any time.
11. LIABILITY TERMS UNSTAFFED ACCESS
First Class Fitness are not trading 24/7 or unstaffed at present.
If this changes T&C below will apply
All members are responsible and assume all the risk for their safety including injury or death while training in or outside of staffed hours, on premises or while entering or leaving. We reserve the right to change the class timetable without notice and reserve the right to change operational hours at our discretion. The member understands that we will offer no security outside of security mentioned in .4 of waver. We strongly suggest you do not train alone outside of staffed hours. If you do it is at your own risk.
12. Government mandated shutdowns
In the event of a government mandated shut down all membership payments will be suspended until shut down ends.
All payments will commence as soon as any government mandated shut down finishes.
All minimum payment terms will need to be honoured.
13. Membership Cancelations
All memberships require 30 days notice period to cancel account out side of minimum contracted term ,
Memberships can not be cancelled within minimum term unless they meet one of the below criteria
1 Relocation
2 Medical exemption
3 Management approval
All of these are subject to proof being provided to centre , and 30 day notice period.
All minimum payment terms will need to be honoured.
